The National Union of Cameroonian Footballers (SYNAFOC) is considering appealing to FIFA due to what it perceives as a failure by the Cameroonian Football Federation (FECAFOOT) to implement court decisions favorable to players.

In a statement released on Saturday, April 13, 2024, SYNAFOC mentioned a series of 36 decisions made in favor of players since 2014, which have neither been implemented nor communicated by FECAFOOT.

“In light of FECAFOOT’s silence, SYNAFOC is considering bringing the matter to FIFA, in accordance with the provisions of Article 21 of the Disciplinary Code of the world football governing body,” as stated in their communication.

UNEXECUTED DECISIONS: SYNAFOC ANNOUNCES IMMINENT FIFA APPEAL
The National Union of Cameroonian Footballers (SYNAFOC) has revealed a list comprising 36 decisions favorable to players made since 2014, but which have not been implemented or communicated by the Cameroonian Football Federation (FECAFOOT).

In response to FECAFOOT’s silence, SYNAFOC is considering taking the matter to FIFA, relying on the provisions of Article 21 of the Disciplinary Code of the main global football organization, as stipulated in this article.

Article 21: Non-compliance with a decision

Any individual (for example, a player, coach, or club) or FIFA itself who fails to pay or fully pay an amount due following a decision of a FIFA body, committee, subsidiary, or instance, or a decision of the Court of Arbitration for Sport (CAS), or who fails to comply with a non-financial decision of these authorities: a) shall be sanctioned with a fine for non-compliance with the decision and may be subject to additional disciplinary measures; and, if necessary: b) shall be granted a final deadline of 30 days to settle the debt or comply with the non-financial decision; c) may incur an annual interest rate of 18% on the debt, starting from the date set by the Disciplinary Committee following an appeal decision of the CAS; d) in the case of a club, shall face a ban on registering new players after the final deadline if payment is not made or full compliance with a decision is not achieved. This ban remains in place until full payment is made or compliance is achieved. Further penalties such as point deductions or relegation may also be applied for persistent non-compliance; e) in the case of a federation, additional disciplinary measures may be imposed after the final deadline if it still has outstanding payments or has not fully complied with a decision; f) in the case of an individual, may face a ban from participating in any football-related activity for a specified period after the final deadline if they remain in a state of non-compliance.

Further disciplinary actions may also be imposed.

Disciplinary proceedings for financial decisions may only be initiated at the request of the creditor or any other affected party, who has the right to be informed of the final decision and the reasons for that decision if requested.
If the sanctioned party fails to comply with the final deadline, FIFA and/or the relevant federation must enforce the imposed sanctions. If a ban on registering new players (in the case of a club) or a ban on participating in any football activity (in the case of an individual) or disciplinary action (in the case of a federation) has been implemented in accordance with this article and related to a financial obligation resulting from a decision of the CAS or FIFA, this ban or action may be temporarily lifted if evidence of compliance with the decision is presented to FIFA. a) If the debtor has provided accurate information and has fulfilled all financial obligations, the ban or measure is permanently lifted. b) If the debtor has provided inaccurate information and/or has not fulfilled all financial obligations, the Disciplinary Committee may: i) reactivate the ban or measure; ii) impose additional disciplinary actions.

A sporting successor of a party guilty of non-compliance with a decision must also adhere to the obligations set out in this article.

Any financial or non-financial decision against a club taken by a competent decision-making body within the relevant federation must be executed by that federation according to the principles of this article and the applicable disciplinary regulations. Failure to execute the decision may result in a fine and additional disciplinary measures against the federation for persistent non-compliance.

Any decision against an individual taken by a decision-making body within the relevant federation must be executed by that federation or by the individual’s new federation if they have meanwhile been registered or licensed with another federation.
