Arnaud Nyemb holds a Master’s degree in sports law and resides in Lyon, France. According to him, the appointment of a new staff for the Indomitable Lions by the executive committee of the Fecafoot does not comply with the current laws and conventions.
In Arnaud Nyemb’s view, the technical staff appointments made by the president of Fecafoot are null and void, even considering FIFA’s recommendations. “Indeed, in its letter to Fecafoot, FIFA asked the parties to respect Article 9 of the 2015 Convention, which on one hand stipulates that Fecafoot may appoint members of the technical staff only after MANDATORY ADVICE from the minister of sports, or by the state providing members of the technical staff,” explains the sports lawyer.
“The President of Fecafoot, through the Executive Committee, chose to designate and appoint the members of the technical staff themselves. However, this decision is null because it requires the mandatory advice of the minister of sports. In law, mandatory advice implies that a text or decision cannot be made until the formal opinion of the authority required to provide it has been obtained, even if the signatory of the act does not follow their position,” he continues.
